1. Acceptance of Terms

By accessing or utilizing services provided by SmithBuilt Studio ("smithbuilt.site"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Service Description & Turnaround SLA

SmithBuilt Studio provides web design, website build, and managed hosting on AWS CloudFront infrastructure.

• 48-Hour Delivery Guarantee: Applies to initial prototype preview delivery following receipt of complete client brand assets, text, and domain information. Delayed client asset submission pauses the 48-hour clock.
• Performance Benchmark (100/100 Lighthouse): Speed guarantees apply to core static layout templates served on AWS CloudFront edge networks. Third-party unoptimized external embeds (e.g. heavy external tracking scripts) may impact score results.
• Uptime SLA: Hosting uptime is backed by AWS CloudFront global edge network infrastructure (99.9% target SLA). SLA remedies for downtime are limited to monthly service credits.

3. Billing & Cancellations

Upfront setup fees ($499 Starter / $999 Growth) cover initial custom website design and infrastructure provisioning. Monthly hosting retainers ($29/mo Starter / $49/mo Growth) cover ongoing DNS, SSL, CDN edge bandwidth, and included monthly edits. Subscriptions may be cancelled at any time with 30 days written notice.

4. Intellectual Property & Ownership

Upon full payment of setup fees, clients retain 100% ownership of all custom website code, text, logos, and image assets provided. SmithBuilt Studio retains ownership of core platform CDK deployment scripts and proprietary infrastructure code.

5. Limitation of Liability

SmithBuilt Studio shall not be liable for indirect, incidental, or consequential damages resulting from website downtime, client domain registration failures, or third-party network outages.
